Welcome to Hotelzz.in. These Terms of Service ("Terms") govern your access to and use of the website https://hotelzz.in and all related services, content, and tools (collectively, the "Platform") operated by Hotelzz.in ("we", "us", "our").

By accessing or using the Platform, submitting a form, or contacting us via WhatsApp, you (the "User") agree to be bound by these Terms. If you do not agree, please do not use the Platform.

These Terms are an electronic record under the Information Technology Act, 2000 and the rules made thereunder. They do not require any physical, electronic, or digital signature and are generated by a computer system in accordance with Section 10A of the IT Act.

We act as an intermediary within the meaning of Section 2(1)(w) of the IT Act and Rule 2(w) of the Intermediary Guidelines, 2021. We do not own, operate, or manage the Properties listed on the Platform unless explicitly stated.

3.1 How bookings work

When you submit a booking enquiry through the Platform:

  1. Your details are sent via WhatsApp to the Hotelzz team.
  2. We coordinate with the Property to confirm availability and rate.
  3. The actual booking contract — including payment, check-in/check-out, and house rules — is between you and the Property. Hotelzz.in is not party to that contract.

3.2 Pricing

Prices displayed on listings pages are indicative and may change based on season, availability, length of stay, taxes, and offers. The final rate quoted by Hotelzz on WhatsApp at the time of booking shall prevail. We do not guarantee that displayed prices match actual rates at the time of booking.

3.3 Payments

Hotelzz.in does not currently process payments on the Platform. Payments are made directly to the Property or via a payment link the Property sends to you. We are not responsible for payment disputes between you and the Property; raise such disputes directly with the Property.

3.4 Cancellations & refunds

Each Property sets its own cancellation and refund policy. The standard policy displayed on the Platform ("free cancellation up to 48 hours before check-in") is illustrative; the binding policy is the one confirmed in writing by the Property when your booking is confirmed.

Listings on the Platform may include photos, descriptions, ratings, amenities, and address details. We make reasonable efforts to ensure accuracy but:

7. Intellectual Property

All content on the Platform — including text, graphics, logos, the "Hotelzz" word mark, layouts, and software — is the property of Hotelzz.in or its licensors and is protected by copyright, trademark, and other Indian intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission, except for personal non-commercial use.

Listing data sourced from third-party Properties or public sources (e.g. Google Maps) remains the intellectual property of their respective owners and is used here under fair-use principles for marketplace facilitation.

8. Third-Party Links & Integrations

The Platform may contain links to third-party websites, services, or products (e.g. Google Maps, WhatsApp, OTA platforms). We do not endorse, control, or assume responsibility for any third-party content, products, or services. Your interactions with third parties are at your own risk and governed by the terms of those third parties.

9. Disclaimers

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Hotelzz.in disclaims all warranties — express, implied, statutory, or otherwise — including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and continuous availability.

We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any listing, rating, or third-party content.

10. Limitation of Liability

To the maximum extent permitted by law:

You agree to indemnify, defend, and hold harmless Hotelzz.in, its affiliates, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or third-party right; (c) any content you submit to the Platform; or (d) any dispute between you and a Property.

12. Suspension & Termination

We may suspend or terminate your access to the Platform at any time, without notice and without liability, if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to the Platform, other Users, or third parties. Sections that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnity, and Governing Law — shall survive.

13. Changes to these Terms

We may revise these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra, India.

Before initiating litigation, the parties shall attempt to resolve any dispute through good-faith discussion for at least thirty (30) days from the date of written notice of the dispute.
